{"id":24316,"date":"2020-12-21T10:16:53","date_gmt":"2020-12-21T15:16:53","guid":{"rendered":"https:\/\/web.uri.edu\/global-draft\/?page_id=24316"},"modified":"2025-12-15T11:20:07","modified_gmt":"2025-12-15T16:20:07","slug":"filing-a-tax-return","status":"publish","type":"page","link":"https:\/\/web.uri.edu\/global\/office-of-international-students-and-scholars\/current-students-and-scholars\/tax-information\/filing-a-tax-return\/","title":{"rendered":"Filing A Tax Return"},"content":{"rendered":"\n<p>If you received US-source income (for example from on-campus employment, CPT employment, OPT employment, J-2 EAD employment, or a scholarship over the amount of tuition), you will need to file a tax return \u2013 both federal and state.<strong>&nbsp;<\/strong>&nbsp;Not only is this a legal requirement, it is in your best interest to file as you may be due a tax refund.<\/p>\n\n\n\n<p>Before you begin the filing process, be sure you have all the necessary documents with you.&nbsp;Here are some of the documents required for completing a tax return:<\/p>\n\n\n\n<p><em>Note: Not all students will have the same tax documents.  Documents may vary depending on your personal situation and income.<\/em><\/p>\n\n\n\n<p>Statements are usually mailed to your mailing address in e-campus annually between late January to early March. <\/p>\n\n\n\n<figure class=\"wp-block-table is-style-regular\"><table><thead><tr><th>\u2713<\/th><th>Necessary Documents<\/th><th>Description<\/th><\/tr><\/thead><tbody><tr><td><\/td><td>W-2<\/td><td>This form shows how much you earned last year and how much was taken out for taxes.&nbsp; You will only receive this form if you have been employed.&nbsp; You will receive one form from each employer by mail. <br><br>You can also view\/download your URI W-2 from, by logging in to e-Campus and navigate to Main Menu&gt;Self Service&gt;Payroll and Compensation&gt;View W-2.<\/td><\/tr><tr><td><\/td><td>1099 Form<\/td><td>This form is often used for short-term, contract employment.&nbsp; Some CPT and OPT employment will use this form.<\/td><\/tr><tr><td><\/td><td>1042-S Form<\/td><td>This form is used to report scholarship income exceeding the amount of tuition and income covered by a tax treaty. For example athletic scholarship and fellowship recipients will be issued a 1042-S. <br><br>It&#8217;s usually issued by March 15 at the latest. The 1042-S will be mailed in the postal mail to your mailing address in e-campus. If you did not receive your 1042-S, please e-mail <a href=\"mailto:ForeignTax@etal.uri.edu\">ForeignTax@etal.uri.edu<\/a> to obtain a new copy.<\/td><\/tr><tr><td><\/td><td>Passport<\/td><td><\/td><\/tr><tr><td><\/td><td>Immigration Document<\/td><td>I-20 (F-1 status), DS-2019 (J-1 or J-2 status)<\/td><\/tr><tr><td><\/td><td>Social Security number or Individual Tax Identification number (ITIN)<\/td><td><\/td><\/tr><tr><td><\/td><td>Address Information<\/td><td>Current US address and foreign address<\/td><\/tr><tr><td><\/td><td>Entry and Exit Dates<\/td><td>for current and past visits to the US (To access your U.S. Travel History from the Customs &amp; Border Protection, visit the <a rel=\"noreferrer noopener\" href=\"https:\/\/i94.cbp.dhs.gov\/I94\/#\/home\" target=\"_blank\">I-94 website<\/a>.)<\/td><\/tr><tr><td><\/td><td>Academic institution or host sponsor information<\/td><td>Name, address, phone number<\/td><\/tr><tr><td><\/td><td>Copy of last year&#8217;s federal income tax return<\/td><td>If filed<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n<div class=\"cl-wrapper cl-boxout-wrapper\"><div class=\"cl-boxout right  \"><h1>Filing Tips<\/h1><p><\/p>\n<ul>\n<li>Make photocopies of your documents for your records<\/li>\n<li>Be careful to complete the correct form<\/li>\n<li>Sign and date all forms, and be sure to mail them before the stated deadline<\/li>\n<li>If including payment, take a look at the <a href=\"https:\/\/www.irs.gov\/payments\/pay-by-check-or-money-order\">IRS guidance<\/a> on paying by check or money order.<\/li>\n<\/ul>\n<p><\/p><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Determining Residency for Tax Purposes<\/u><\/strong><\/h2>\n\n\n\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.sprintax.com\/\" target=\"_blank\">Sprintax<\/a> is helpful for determining residency status and for completing tax returns for non-resident tax payers. You may be in F-1 or J-1 non immigrant status and considered a resident for tax purposes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Nonresident<\/u><\/strong><\/h2>\n\n\n\n<p>F-1 students and J-1 students are considered nonresident for tax purposes if they have been in the US for a total of less than five years.&nbsp; J-1 scholars are considered nonresidents for tax purposes if they have been in the US for less than two years.&nbsp;Nonresidents will use Form&nbsp;<a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f1040nr.pdf\">1040NR<\/a>&nbsp;(<a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/i1040nr.pdf\">instructions<\/a>) in addition to Form&nbsp;<a href=\"http:\/\/www.irs.gov\/pub\/irs-pdf\/f8843.pdf\">8843<\/a>.&nbsp;<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.sprintax.com\/\">Sprintax<\/a> software is a good resource for students filing as non-residents.<\/p>\n\n\n\n<p><strong>Forms must be sent by mail to:<\/strong><\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<figure class=\"wp-block-table alignleft is-style-regular\"><table><tbody><tr><td> <em>If you are NOT enclosing payment:<\/em>                                                            <br><br>Department of the Treasury&nbsp;<br>Internal Revenue Service<br>Austin, TX 73301-0215 &nbsp;<\/td><td><\/td><\/tr><tr><td><em>If you are enclosing<\/em> a payment:<br><br>Internal Revenue Service<br>P.O. This will not affect your immigration status. Sprintax and other tax software will give you the option on completing a state return as well.  If you worked in another state on CPT or OPT, you may need file a tax return for that state.  A few states do not have state income tax, but most do.<\/p><\/div><\/section>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<h2 class=\"wp-block-heading\">Tax Support Resources<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.sprintax.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sprintax<\/a><\/p>\n\n\n\n<p>Their tax software is specifically designed for international students and scholars who are considered nonresidents for tax purposes. You will need to fill in your information and answer some questions, and the software will determine what forms you need to file. The cost of this service is generally between $50-$100, depending on how many forms you are required to file.
