{"id":818,"date":"2018-06-05T14:16:02","date_gmt":"2018-06-05T14:16:02","guid":{"rendered":"https:\/\/www.uri.edu\/global\/?page_id=818"},"modified":"2024-02-02T16:16:51","modified_gmt":"2024-02-02T21:16:51","slug":"tax-information","status":"publish","type":"page","link":"https:\/\/web.uri.edu\/global\/office-of-international-students-and-scholars\/current-students-and-scholars\/tax-information\/","title":{"rendered":"Tax Information"},"content":{"rendered":"\n<p><strong>It is important to be aware that, as an international student or scholar present in the US from January 1 to December 31 of any given year, you\u2019re legally required to file a tax return in April of the following&nbsp;year<\/strong> <strong>if you received US income.<\/strong><\/p>\n\n\n\n<p><em> If you&#8217;re a <strong>non-resident for tax purposes <\/strong>and didn\u2019t work or receive income in the US, you\u2019re still obliged to file a Form 8843 with the IRS.<\/em><\/p>\n\n\n\n<p><em><strong>Important note:<\/strong><\/em> The staff at the OISS are not trained in taxation, and therefore cannot answer specific tax questions or help you prepare your tax forms. It is your responsibility to meet your tax obligations and do so accurately.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who Must File A Tax Return?<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table><thead><tr><th>Filing IS required by nonresident alien students and scholars who have:<\/th><th>Filing is NOT required by nonresident alien students who have income ONLY from:<\/th><\/tr><\/thead><tbody><tr><td>A taxable scholarship or fellowship, Tax Benefits for Education<em> above the amount of tuition<\/em><\/td><td>Foreign sources<\/td><\/tr><tr><td>Income partially or totally exempt from tax under the terms of a tax treaty<\/td><td>Interest income from a U.S. bank, a U.S. savings &amp; loan institution, a U.S. credit union, a U.S. insurance company<\/td><\/tr><tr><td>Any other income, which is taxable under the Internal Revenue Code<\/td><td>An investment, which generates portfolio interest<\/td><\/tr><tr><td><\/td><td>A scholarship or fellowship that covers only tuition<\/td><\/tr><tr><td><\/td><td>Any other income which is not taxable under the Internal Revenue Code <\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<h2 class=\"wp-block-heading\"><strong><u>Determining Residency for Tax Purposes<\/u><\/strong><\/h2>\n\n\n\n<p>In legal terms, non-citizens of the US are called \u201caliens.\u201d There are two types of aliens for tax purposes: nonresident and resident.\u00a0\u00a0<strong>These categories are for tax purposes only and are not related to your immigration status.<\/strong>\u00a0\u00a0\u00a0You may be in F-1 or J-1 non immigrant status and considered a resident for tax purposes.\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.sprintax.com\/\" target=\"_blank\">Sprintax<\/a>\u00a0is helpful for determining residency status and for completing tax returns for non-resident tax payers.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\"><div class=\"cl-wrapper cl-card-wrapper\"><a class=\"cl-card  \" href=\"https:\/\/web.uri.edu\/global\/international-students\/employment\/tax-information\/filing-a-tax-return\/\" title=\"\"><div class=\"cl-card-container text\"><div class=\"cl-card-text\"><h2>Filing A Tax Return<\/h2><p>For those that have earned an income in the United States.<\/p><\/div><\/div><div class=\"cl-card-container button\">Tax Information<\/div><\/a><\/div><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>IRS Form 8843<\/strong><\/h2>\n\n\n\n<p><strong>All Nonresident Alien for tax purposes, students, scholars and their dependents in F-1, F-2, J-1 or J-2 status present in the U.S. must file the IRS <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8843.pdf\">Form 8843<\/a>, even if no U.S.-sourced income was received.<\/strong> Form 8843 is not a tax return, but an informational statement required by the U.S. government.<\/p>\n\n\n\n<p>Income which is not taxable because of an income tax treaty must be reported on a U.S. income tax return even though no income tax is due on the U.S. income tax return.<\/p>\n\n\n\n<p>This form is solely informational \u2013 you will not be required to submit any payment.<br>Students need only complete Sections I and III, scholars need only complete Sections I and II. Make sure to sign the last page<\/p>\n\n\n\n<p><strong>IRS Form 8843 must be mailed to: <\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center\">Department of the Treasury<br>Internal Revenue Service<br>Austin, TX 73301-0215<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Identify Theft<\/h2>\n\n\n\n<p>Please be careful of scams and internet \u201cphishing\u201d that use the IRS name or other tax-related references to gain access to your personal information in order to commit identity theft. The IRS does not send emails or request personal information by email or phone.
