Students involved in cases will:<\/p>\n\n\n\n<ul class=\"wp-block-list fullwidth\">\n<li><em>Receive clear information about their rights and responsibilities.<\/em><\/li>\n\n\n\n<li><em>Have the opportunity to participate in meetings or hearings to share their perspective.<\/em><\/li>\n\n\n\n<li><em>Have the opportunity to work with trained advisors.<\/em><\/li>\n\n\n\n<li><em>Learn how to appeal or complete assigned sanctions.<\/em><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center fullwidth\"><strong>How the Student Conduct Process Differs from the Criminal Justice System<\/strong><\/h2>\n\n\n\n<p class=\"fullwidth type-intro\">The University of Rhode Island\u2019s student conduct process is distinct from criminal court proceedings. While a student may be involved in both systems at the same time, the conduct process serves a different purpose and follows different procedures.<\/p>\n\n\n\n<ul class=\"wp-block-list fullwidth\">\n<li><strong>Educational, not adversarial:<\/strong> A conduct hearing is not a trial. It is designed to be supportive, non-adversarial, and educational. The focus is on helping students understand the impact of their choices and encouraging accountability, not on punishment.<\/li>\n\n\n\n<li><strong>Standard of evidence:<\/strong> Unlike the criminal justice system\u2019s standard of \u201cbeyond a reasonable doubt,\u201d URI uses a \u201cpreponderance of the evidence\u201d standard. This means that a student will be found responsible if it is more likely than not that a violation occurred. Legal rules of evidence do not apply; hearing officers may consider all relevant information.<\/li>\n\n\n\n<li><strong>Confidentiality:<\/strong> Student conduct records are protected under the Family Educational Rights and Privacy Act (FERPA). They are not public records, unlike criminal cases. A conduct finding will not result in a criminal record.<\/li>\n\n\n\n<li><strong>Independent outcomes:<\/strong> Criminal court findings of \u201cguilty\u201d or \u201cnot guilty\u201d do not determine the outcome of the student conduct process. The two systems operate separately.<\/li>\n\n\n\n<li><strong>Individualized sanctions:<\/strong> Sanctions are not automatic. They are determined by the circumstances of each case, the impact of the behavior, and any prior history.
